Actualising Capacity in Chinese-Speaking Asia

在社交生活中，不論就業或婚姻，心智障礙人士都被奪其自決的權利。大多法律制度更在沒有他們的知情同意下將他們轉介到精神病院接受治療。因此，社會有迫切需要根據《殘疾人權利國際公約》第十二條在法律上承認他們的法定能力，以表彰其自治，意願及選擇。 是次會議集合亞洲各國華語社區的律師（當中包括中港台，馬來西亞及新加坡的法律工作者）以及來自加拿大，英國，美國及以色列的殘疾人權利法專家，以探討如何最佳實踐《殘疾人權利國際公約》及當中所面對的挑戰。From employment to marriage, persons with psychosocial and intellectual disabilities are often deprived of their right to make their own decisions in all aspects of social life. Many laws further commit them to psychiatric and mental institutions without their informed consent. Formally recognising their capacity in law and, as such, honouring their autonomy, will, and preferences in accordance with Article 12 of the United Nations Convention on the Rights of Persons with Disability (UNCRPD) is thus an important and pressing task. Bringing together legal practitioners from Asia’s Chinese-speaking societies (including lawyers from Mainland China, Taiwan, Malaysia, Singapore and Hong Kong) and leading international experts in the area, this conference aims at exploring the challenges and best practices to effectively implement the CPRD.
